A Dutch collecting society emails us about your Amsterdam server. What happens?
You have probably read that an EU server ignores the DMCA. Half of that is right, and the wrong half is the half that decides things.
As a United States instrument that letter does nothing here: the Netherlands gives us no takedown clock to run and no counter-notice to file. But we are established inside the Union, and the Union has an answer of its own. The Digital Services Act obliges every hosting provider here to accept a complaint and deal with it, and once one carries the detail Art. 16(2) sets out we are treated as knowing what it says — with Art. 6(1) withdrawing our liability exemption if we then sit on it.
So: we read it, we tell you what arrived and who sent it, and you get a real opportunity to answer before anything touches your server. What we cannot tell you is that only an order from a Dutch court will ever move us, because inside the Union that describes a shield we do not have. If you want a letter that lands with nothing at all behind it, that is Iceland, Moldova, Panama or Seychelles.

What data retention law applies in Netherlands?
The Dutch general retention duty has not been in force since a court in The Hague suspended it in March 2015, the EU directive it implemented having been annulled the year before. Nothing here asks us to start writing a log we would otherwise not write, and access logs are kept for 0 days.
